There is a very good chance that the gov't will seek to remove your son from the US even if he is only found guilty of misdemeanors.
And why is that?
The misdemeanors could be NOT CMT....only CMT crimes are deportable or serious felonys right?
If the crimes are not crimes of moral turpitude then they are not deportable under immigration law?

Most of the major airlines require 15000 to 25000 miles for flying inside the continental US. Thanks for digging through the threads and making an offer. Just make sure you use your skymiles number on delta and with delta's partners. If you are going out on an international trip that will get you there faster. I am having tough time in getting an appointment with my local Representative and let them know what out problems are. And now this DEC bulletin is making my head spin.

Hi Everybody,
I know that nobody has an answer for my question, but still i would like to get the views/inputs from the seniors here , who have experience with USCIS.
When do you think a person with PD of Nov 2007 ,EB3 from India, would be able to file for 485??
As Lacrosse said most probably 3-4 years but you never know .. you can get lucky like this year when USCIS made everything current for July . If a month like that comes along then you would be able to file for AOS .
A miracle can happen but if it doesn't your wait time could be anything from 3 - 5 years or

by now everybody might have heard stories about how USCIS pulled staff and worked overtime and weekends to utilize the 60k visas in one month to prevent the july 485 filings.
What I am wondering is why did they do it. One obvious reason is the incresed fee comming into effect from July 30 2007. In addition to it what are the other reasons.
Is there any agenda within USCIS to prevent people from getting EAD and ac21 benefits?
Is USCIS filled with anti immgrant mentality who have takem upon themselves to make our lives difficult?
Maybe politicians involved - only when powerful politicians are involved such things happen - USCIS/DOS does not do such things on its own.

Its not fair to make such comments on her. Its very unprofessional from ourside to act like that even before a help denied by her. I think IV needs everyones help and input. Anyone including her might be of great help if they are convinced with our cause and willing to help. And, they deserve a respect.
By the way, i am neither a supporter of indian govt nor belong to a minority community.

while, most of us do not have Canada perm residentship. why should we face that issue? I was only concerned with any other issue due to the fact of mere visiting canada on greencard? if it can raise any suspicion (or any technical issue) of abandoning the pending or approved GC?

I think thousand is over exagerated. Most people have filled their application at NSC.
I also have a consiparacy theory now. The dates porbably have moved out because of TSC as they did not have enough cases to process.
U may be right. Do you know the NSC, TSC 485 break up. This is the first time I have heard that NSC has way more apps than TSC. Sorry I may be behind the curve on this..........

very frustrating.. Aug is here, and my PD is current now (using old employer 140).. but cannot file 485 since fragomen-PERM stuck in audit for current employer!!!
I was waiting for PD to become current for almost 2-3 years.. at old employer... now its current.. and i cannot do anything... !!!! just wait and watch!!.. Audit result expected in 6-8 month per fragomen.. 6 years of h1b expiring in 10 months!

Was just going back down memory lane...
In the 80's - most of 90's, traveling to the US (as a visitor) was so off limits; not because of visa issues or that there wasn't someone to visit here, but for the simple reason that middle class or even upper middle class in India just couldn't afford or justify the expense. Those were the days when highly educated people, having a very stable income source used to feel proud that they have booked a Bajaj scooter (delivery would take years!). Owning a color TV was remarkable, traveling to a foreign country was just unfathomable!
So much has changed in these past 10-15 years!

Thank you all for your repiles. I have asked my wife to talk to their lawyer directly.
It is not a rule, but it depends on how the approval is given by USCIS. If you get a extended I94 along with the H1 approval then you are all set, if you get an approval with no I94 then you need to get a stamping before starting work. Consult lawyers they will explain it better.
My wife went through the H4 - H1 Conversion which got approved last week, we are still wating to see the approval document.
